Vinay Kohli is a partner in the Health Care Group and Litigation Department. Vinay is a seasoned trial lawyer with more than a decade of experience representing clients in the health care provider industry—including hospital systems, physicians, and post-acute care facilities as well as healthcare technology and revenue cycle management companies.
Recognized for his focus and commitment to the healthcare industry, a wide range of health care businesses use Vinay as an outside general counsel to guide them on strategic planning issues, compliance matters, operational questions, and reimbursement issues. He provides regulatory, compliance, reimbursement advice on topics that range from venture formation and risk management to an array of contract negotiations.
He is also experienced in defending health care fraud and abuse litigation, prosecuting managed care disputes against payors, and handling government investigations. He is frequently called upon to serve as lead trial counsel in commercial litigation disputes for health care industry clients that span the gamut from trade secret misappropriation, unfair business practices, and breach of fiduciary claims.
Vinay received his B.B.A., magna cum laude, M.A., and J.D. from the University of Texas at Austin in 2005, 2006, and 2009 respectively.
Prior to joining Proskauer, Vinay was a partner in the Healthcare and Commercial Litigation groups at King & Spalding.

- Zotec Partners Litigation. Lead trial counsel for radiology practices and private-equity backed management services organization in multi-forum trade secret litigation involving medical billing and coding issues.*
- In re Skilled Nursing Facilities, JCCP No. 4988. Served as lead class action defense counsel for the administrative services entity in a group of twenty class action matters arising from alleged understaffing.*
- State ex rel. Rapier v. SRCC Assocs., LLC, et al., Case No. BC 641254 (Cal. Super. Ct). Featured member of the trial team that secured a complete and precedent-setting defense verdict against the California Department of Insurance (CDI) and a relator in a significant Insurance Frauds Prevention Act (IFPA) trial.*
- Sunrise Hospital System v. Sierra Health Services/United Healthcare. Represented the Sunrise Hospital system in Las Vegas against United Healthcare's Nevada affiliate in a multitude of managed care litigation and arbitration matters arising from underpayment of emergency medical services, post-stabilization services, and NICU inpatient care.*
- Universal Health Services, Inc. v. Aetna. Represented a large hospital system in an out-of-network underpayment dispute arising from the use of a leased network. The case was resolved favorably for the client prior to trial.*
- Alaburda v. Thomas Jefferson School of Law. Trial counsel (second-chair) of a historic jury trial against a law school for the misreporting of employment statistics. The case was later credited as one of the catalysts of reform to the legal education services industry.*
- Golightly v. Molina, 229 Cal. App. 4th 1501 (2014). A key member of the legal team in both trial court and the Court of Appeal that successfully defended Los Angeles County Board of Supervisors in a widely-publicized taxpayer lawsuit that targeted their budgeting practices. After years of litigation, the County prevailed on summary judgment and the judgment was upheld on appeal.*
- SCC Alameda Point v. City of Alameda. Successfully represented one of the country's largest privately-owned real estate developers against a municipality based on the alleged breach of an exclusive negotiating agreement.*
- Technology Integration Group v. Trace3, Inc. Obtained dismissal of trade secret misappropriation and unfair business practices claims on summary judgment on behalf of a technology company and its employees (AAA Arbitration).*
