Brad Ruskin has served four years as co-chair of the Litigation Department and four terms as a member of the firm's Executive Committee.
During the past several years, Brad has tried a significant number of high profile, headline-generating cases to verdict, each one with a complete victory for Proskauer’s clients on issues ranging from so-called “bet-the company” antitrust challenges to questions of Russian constitutional and military law.
As head of the litigation section of Proskauer’s preeminent Sports Law Group, a significant portion of Brad's practice is dedicated to litigating issues and counseling clients active in the sports business. The Sports Law Group has been recognized as the country’s top Sports Law group at the Chambers USA Awards for Excellence ceremony and as a “Tier 1” practice in numerous leading legal publications. Among the league and conference clients for whom he performs services are Major League Baseball, the National Hockey League, Major League Soccer, National Football League, National Basketball Association, ATP World Tour, WTA, PAC-12, and certain departing members of the Big East Conference. In addition, Brad has represented ownership groups and clubs in each of the major U.S. sports (including the Florida Marlins, the New York Jets, the Philadelphia Eagles and the New Jersey Devils), and media companies in sports-related disputes.
Communications, Media and Technology:
Brad represents numerous communications, media and technology companies in a wide variety of litigated disputes, including partnership issues, communications and copyright law issues, bankruptcy disputes, data breaches, contract rights and complex class actions. His recent clients include T-Mobile USA; Satyam Computer; ML Media Partners; Madonna; the RP Media Companies; American Zoetrope; and the Rascoff/Zysblat Organization.
Financial Services Companies:
Brad also represents numerous financial services companies on a broad range of disputes, including contract, bankruptcy, investment, partnership, non-compete, and trade secret issues. Among his recent clients are JPMorgan Chase and various Merrill Lynch partnerships.
Antitrust and General Commercial Disputes:
Brad regularly defends clients in antitrust cases, including at present entities such as Sanofi Pasteur and Major League Baseball. Most recently, after a two-week jury trial, he won a defendant's verdict on behalf of the ATP Tour (the men's professional tennis circuit). The verdict, under Sections 1 and 2 of the Sherman Act, was upheld on appeal by the Third Circuit. Brad also regularly handles a wide range of litigated matters, including contract, fraud, licensing, trademark, franchising, partnership, intra-corporate, bankruptcy, unfair competition, and other commercial disputes. He has litigated trust matters throughout the country in various federal and state courts and in domestic and international arbitral forums. Brad also has handled proceedings (along with foreign co-counsel) before the European Commission and the Office of Fair Trading.
Brad currently serves as a Member of the Executive Committee and Director of the Legal Aid Society, the nation's oldest and largest provider of legal services to the indigent. He is also a Director of the Young Women's Leadership Network, a preeminent organization providing specialized educational opportunities to low-income students. He is a frequently published author of articles, has taught a graduate school class at NYU's Tisch School, and has testified before legislative and other bodies concerning administration of justice and court operations in New York State.
