Mark Fennessy

Mark Fennessy is a partner and heads Proskauer’s European Restructuring Group.

Mark has extensive knowledge of, and experience in, all areas of contentious and non-contentious turnaround and insolvency matters. His particular strengths lie in dealing with multifaceted group collapses and insolvency issues of an international nature. He has been involved in a number of high-profile assignments for banks, funds and various strategic parties in matters related to Wind Hellas, Lehman Brothers, MF Global (acting for the chapter 11 committees), ATU DTEK, Codere and most recently Westinghouse Group (acting for the Chapter 11 Committees).

Since the onset of the financial crisis in 2007, Mark has had extensive experience in the restructuring of securitization structures including structured investment vehicles (SIVs) such as Cheyne Finance (for which Mark’s team was recognized with the 2009 IFLR “Restructuring of the Year” award), Rhinebridge, Whistlejacket and Sigma.

He has actively led a number of complex litigation matters and has significant experience in the investigation of complex fraud cases, multijurisdictional disputes, anti-avoidance/antecedent transaction advice, corporate investigation and analysis, and the development of litigation strategies. Mark acted for a bondholder group in the liquidation of ARM Asset Backed Securities.

Mark is consistently ranked as a leading lawyer for Corporate Restructuring and Insolvency in Chambers UK and The Legal 500 United Kingdom, and has been described as a "standout" and as "innovative, quick-thinking and extremely industrious, always seeking to maximise positive results for the client” with a "very responsive and personable team." Mark is a member of the 'Britain in Europe' think-tank of Brunel Law School, and frequently lectures at industry events including at Insol Europe (Istanbul 2014 and Nottingham 2015) and ABI Europe (Annual Conferences: Dublin 2012 and London 2014).
