Our first and second year associates participate in weekly informal lunch lectures which cover the basics of the practice. Also, we take client service seriously and prepare our associates to perform their best through the use of an on-site writing coach, written advocacy training programs and business development training.

Representative Matters

  • We prevailed before the Delaware Supreme Court on behalf of the ATP Worldwide Tour, a case that resulted in a ruling of first impression and a subsequent change in Delaware corporate law.
  • We also won big for Biosig Instruments in a case before the Supreme Court in which Nautilus challenged the validity of Biosig’s heart rate monitor patent.
  • We have lead roles in high-profile restructuring cases, including representing Caesars Entertainment Operating Co.’s Creditors Committee in one of the largest, most contested chapter 11 bankruptcy cases in the U.S. today.
  • We represent China-based China Finance Online and the individual defendants in a securities class action involving alleged material misstatements in SEC filings.
  • We secured a major false advertising bench trial victory for Church & Dwight against its top competitor in the market for home pregnancy tests.
  • We are defense counsel in two of the most high-profile corruption investigations in the world: representing a high-level executive in the multi billion-dollar Petrobras oil company scandal in Brazil and representing the former head of a sovereign wealth fund involved in a major international money laundering investigation.
  • We won a lengthy copyright lawsuit for Madonna, Warner Bros. Records and WB Music in which the Ninth Circuit affirmed the dismissal of a sampling copyright infringement claim alleging that Madonna’s 1990 hit “Vogue” included and concealed an unauthorized sample. The decision held that the sampling was too de minimis to amount to copyright infringement, creating a rare circuit split in the area of copyright law.
  • For Major League Baseball, we successfully argued that baseball’s exemption from antitrust laws applied to the relocation of clubs.
  • We secured a favorable result for T-Mobile in a high-stakes commercial litigation matter relating to a third party’s breach of fiduciary duty and fraud, and are coordinating its response to class action lawsuits for a recent data breach.
  • We are defending Wells Fargo in several highly publicized matters, including a lawsuit brought by the City Attorney of Los Angeles alleging that the bank has engaged in unlawful sales practices.

Proskauer for Good

Underscoring Proskauer’s commitment to community, we are one of the few firms with a full- time pro bono partner, William Silverman, a former federal prosecutor with extensive civil and criminal litigation experience.

In a recent pro bono matter, we helped secure the release of a wrongfully-convicted man who had been incarcerated for 25 years. This case was referred by the Innocence Project, a national litigation and public policy organization that works to exonerate wrongfully- convicted individuals, from which the Firm now has a strong pipeline of cases.

The Firm has a long history of pro bono and corporate social responsibility and is focused in particular on supporting veterans and military families, women in Africa and education.
