Description:
Because of Congress' failure to act, quota allocations for nonimmigrant and immigrant visas remain and are out of date. There is a severe numerical limitation on H-1B visas for professionals, H-2B visas for temporary workers, and an inadequate quota allocation for employment based immigrant visas. As a result, employers find it difficult if not impossible to hire skilled workers and professionals who are not U.S. citizens and residents because of the limited availability of appropriate visas.
In our program, we will address this problem, analyzing what the hiring limitations are, and identifying what strategies are still available for the employment of temporary workers. We will identify what visas remain options for temporary workers, how to deal with quota restrictions and processing delays, developing winning strategies for qualifying foreign workers for employment in the United States, dealing with time limits and processing delays. We will provide practice tips and strategies for those involved in the hiring process to identify which candidates can be considered under the current restrictive environment.
CLE Credit: This transitional continuing legal education program has been approved in accordance with the requirements of the New York State Continuing Legal Education Board for attorneys admitted after October 1, 1997 and experienced attorneys. It has been approved for a maximum of 1.5 credit hours, which may be applied toward the professional practice requirement. Audio and videotapes are not acceptable for transitional continuing legal education for the newly admitted attorney within the first two years of admission to the Bar.
