Lawyers in the Washington office collaborate on a daily basis with practitioners in the firm's other eight offices, bringing to bear the very substantial resources of more than 750 lawyers firmwide. 

Litigation:
The litigators in the Washington office pride themselves on the diversity of their skills and the firm's ability to handle a wide range of complex and multi-party litigation in courts across the country and before most federal agencies and tribunals and in arbitration. For example, litigators in the DC office recently have handled major litigation involving:

  • a multibillion dollar international power contract;

  • Internet jurisdiction;
  • on-line privacy;
  • cable regulation;
  • defense of libel allegations against national publishers;
  • defense of SEC enforcement actions, SEC investigations and shareholder litigation;
  • defense of FTC enforcement actions;
  • as agency counsel, representing the FTC in preliminary injunction actions;
  • as agency counsel, representing the FTC in administrative litigation involving mergers, monopolization and horizontal restraints;
  • diverse employment law matters, including sexual harassment, discrimination and employment-at-will litigation;
  • appeals before several United States Courts of Appeal.

Health Care Law:
Proskauer's health care lawyers in Washington represent a diverse group of the largest and best known health care providers in the country. Those clients include entities that own and operate hospitals, nursing homes, assisted living facilities, managed care organizations, home health agencies, hospice providers, durable medical equipment suppliers and pharmaceutical manufacturers and suppliers, among many others. Proskauer advises clients in areas such as:

  • Medicare and Medicaid reimbursement;
  • quality of care;
  • licensure and certification, including federal and state survey challenges;
  • fraud and abuse compliance;
  • defense of False Claims Act and qui tam litigation;
  • defense of civil and criminal fraud investigations;
  • negotiation of Corporate Integrity Agreements;
  • acquisitions and sales of health care facilities;
  • financing and refinancing;
  • formation and structuring of joint ventures, partnerships and other types of health care business relationships;
  • defense of malpractice negligence and wrongful death lawsuits, as well as complex class action litigation;
  • antitrust, including both compliance and Hart-Scott-Rodino advice; and
  • EMTALA and HIPPA counseling and defense.

Proskauer's health care attorneys are knowledgeable about the business as well as the legal needs of their health care clients. In 1992, the nationally known health care firm of Casson & Harkins merged its practice with Proskauer in Washington. The merger created a strong, nationwide health care practice with the experience and ability to provide knowledgeable, effective, broad-based representation and business advice.

Corporate and Commercial Litigation Practice:
Proskauer's Washington-based Corporate and Commercial Litigation lawyers have a broad-based familiarity with the constantly changing competitive and regulatory environment affecting all segments of the business community and in particular, the financial services industry. Working closely with lawyers and clients in all of the Firm's offices, our nationwide practice includes representation of commercial and investment banking institutions and other financial services firms in complex litigation relating to lender liability matters, government enforcement and regulatory proceedings and investigations, commercial loan workouts, secondary market and loan participation cases, letter of credit litigation, banking fraud, consumer credit, equal credit and fair housing litigation. Our corporate and commercial litigators are also regularly retained in litigation and disputes concerning corporate governance, director liability, failed investment transactions, corporate borrowing and finance, shareholder rights, and real estate, securities and investment partnership controversies. Our litigators appear regularly before the SEC, federal bank regulatory agencies and federal courts at all levels.

Criminal Defense and Corporate Investigations Group:
The attorneys practicing in this area include several former Assistant United States Attorneys, some located in the Washington office and some in our other national offices, who represent individuals and organizations in all phases of government enforcement investigations with significant criminal law implications. They frequently conduct internal investigations for organizations to assist them in detecting, responding to and defending against allegations of improper conduct by their officers and employees.

Our attorneys have defended individuals and organizations in parallel criminal, civil and administrative proceedings with regard to Securities and Exchange law issues, health care issues, general allegations of financial fraud, money laundering, government contracting matters, bribery, embezzlement and international import and export matters. While consulted on a wide range of client issues, our attorneys also serve on various American Bar Association Committees dealing with criminal law issues, and the Advisory Rules Committee for the Court of Appeals for the Armed Services; teach as adjunct faculty at law schools; lecture at continuing legal education seminars; and publish frequently in the criminal law area.

Antitrust:
The attorneys practicing in this area include a former Deputy Assistant Director of the Bureau of Competition of the Federal Trade Commission, located in the Washington office, who represents clients before U.S. and international antitrust enforcement agencies, counsels clients on proposed transactions and practices, and represents clients as plaintiffs or defendants.

Labor and Employment:
Our Washington office regularly handles a wide range of labor and employment matters for local businesses and multi-national corporations, including:

  • defending employers against disability, sex, race and age discrimination claims;
  • representing employers in collective bargaining;
  • securing injunctive relief to stop unlawful strikes and picketing;
  • advising employers on wage and hour, workers compensation and unemployment compensation laws; and
  • appearing before federal and state courts and administrative agencies in labor and employment litigation.

Intellectual Property, New Media and Technology:
The intellectual property lawyers in the Washington office are involved in cutting edge issues involving new media and technology, as well as traditional copyright law. Proskauer has been at the forefront of Internet anti-piracy efforts on behalf of the recording and software industries, and has played a leading role in shaping government policy for the digital world. These lawyers are involved in transactional work for companies doing business on the Internet, including licensing, and regularly litigate significant and novel intellectual property issues. The group is co-chaired by the former General Counsel of the Copyright Office of the United States and a lawyer heralded by MSNBC as "a pioneer in Internet law."

Corporate Securities Practice:
Proskauer represents domestic and foreign clients in matters of corporate and securities law:

  • serving as underwriter's or issuers' counsel;
  • advising clients in takeover and other extraordinary transactions;
  • interpreting and applying SEC corporate finance and other regulations; and
  • representation of clients in SEC administrative enforcement proceedings and investigations.

Our securities practice in DC is headed by the former Director of Corporate Finance at the SEC, who has appeared as an expert witness on myriad securities issues; published widely; and speaks often on SEC matters and related topics.

Community Involvement and Pro Bono:
The lawyers in Proskauer's D.C. office are committed to being of service to the community. Lawyers here serve in leadership positions with the Boys and Girls Clubs of America, the Anti-Defamation League, the National Symphony Orchestra, Food and Friends, and the National Center for Missing and Exploited Children, among many other organizations. In addition, as in other Proskauer offices, we take our pro bono responsibility seriously. Annually through the D.C. Bar Pro Bono Program, we commit a substantial number of hours to helping underserved litigants and others in need of free legal help. Some of the cases we have taken have resulted in broad impact results.
