Robert D. Forbes is an Associate in the Litigation Department, resident in the Los Angeles office. He has experience in a variety of complex litigation matters in both federal and state courts involving contract, antitrust, copyright, trademark, First Amendment, defamation, Internet privacy, director/officer liability, and general commercial disputes. As a member of the Sports Law Group, a significant portion of Robert’s practice is dedicated to litigating issues and counseling clients active in the sports business.

Robert’s representative matters include:

  • Representation of Major League Baseball in its investigation of Frank McCourt’s ownership of the Los Angeles Dodgers and the resulting bankruptcy cases
  • Complete victory on behalf of ATP Tour, Inc. and certain of its directors in a jury trial in the District of Delaware and on appeal to the Third Circuit in defense of antitrust, fiduciary duty, and business tort claims in connection with the restructuring of the ATP World Tour (decision reported at 610 F.3d 820)
  • Successful resolution of trademark infringement litigation on behalf of Tropicana Entertainment, Inc.
  • Dismissal of a purported $500 million breach of contract claim by an international bottler against client Pepsi Cola Co.
  • Representation of New York Jets in successful defense of antitrust and breach of contract claims in connection with offering of personal seat licenses

Robert also has an active pro bono practice, including, among other matters, the representation of indigent artists on behalf of Volunteer Lawyers for the Arts and a Muslim prisoner in connection with First Amendment claims regarding dietary restrictions.

Robert frequently writes on issues relating to his areas of practice. His articles have appeared in BNA’s World Intellectual Property Report, Sports Law Administration & Practice, IP Frontline, and E-Commerce Law Reports, and he is a regular contributor to Proskauer’s Privacy Law Blog.
