Jennifer Scullion is a Partner in the Litigation Department, head of the International Practice Group, and member of the Sports and Antitrust Groups. She leads litigations and appeals for U.S. and international sports and media entities, as well as for multinational groups of investors and corporations. Jennifer’s recent representations for her clients include:

  • Federal jury trial for an international sports league resulting in a defense verdict on all federal antitrust and state law claims
  • Arbitration for a U.S. cable operator resulting in a complete victory in an FCC-governed proceeding to determine fair market value of carriage agreement with a network
  • Bench trial for U.S. investors resulting in an order protecting them against discrimination in an Argentine restructuring proceeding of a media group
  • Federal litigation for sovereign bondholders resulting in entry of more than $700 million in judgments

Trials and Arbitrations

  • Dismissal on the merits of consumer class action claim brought against a U.S. energy company.
  • Arbitration for a professional sports team in an internal league arbitration concerning the payment of fees for telecast rights

Appeals

  • Briefing and argument in the Second Circuit for a group of investors resulting in the reversal of a dismissal and a holding that a U.S. forum selection clause may be enforced against successors to non-U.S. company
  • Briefing and argument in the Sixth Circuit for the League of Women Voters of Ohio, resulting in order upholding the right to pursue constitutional challenges to election administration deficiencies . The order led to a comprehensive settlement and monitoring on remand

Counseling

  • Advising multiple U.S. and foreign programmers and distributors on FCC carriage rules, renewal rights, and competitive threats and remedies
  • Advising international sports leagues concerning competition and governance issues
  • Advising a multinational media production and distribution service on competition issues for a government inquiry

Jennifer has written and presented extensively on international commercial dispute resolution and is editor of Proskauer on International Litigation and Arbitration (www.proskauerguide.com), a comprehensive e-book on cross-border litigation and arbitration. Jennifer is also the author of several chapters on international civil procedure in an upcoming book.

Jennifer also has an active pro bono practice focusing on election law, voting rights, and human trafficking issues. She and dozens of other lawyers and staff at Proskauer have worked with the nationwide Election Protection coalition in each general election since 2006. Jennifer is a Trustee of the Lawyers’ Committee for Civil Rights Under Law and serves on Proskauer’s Pro Bono Initiative Committee.
