Deidre A. Grossman

Deidre A. Grossman is a special counsel in the Employee Benefits & Executive Compensation Group, where she focuses on ERISA Litigation. Deidre has extensive experience defending plan sponsors, fiduciaries and service providers in a wide range of ERISA cases across the country, in both single plaintiff and complex class actions.

Her representations include claims relating to:

  • 401(k) "stock drop" suits
  • Breach of fiduciary duty
  • Section 510/interference with benefits
  • Excessive fee claims
  • Pension plan terminations
  • Prohibited transaction allegations
  • Improper denial of benefits
  • Challenges to the modification and termination of retiree benefits
  • ERISA preemption of state law claims
  • Withdrawal liability

When she is not litigating, Deidre counsels clients on how to administer their employee benefit plans in accordance with ERISA's reporting and disclosure requirements, and on how to avert litigation under ERISA's fiduciary and prohibited transaction rules. 

Deidre is a contributor to Proskauer’s Employee Benefits & Executive Compensation blog. In addition, she is a frequent speaker, particularly for ACI, where she represents the defense perspective on a variety of ERISA litigation issues.

Before rejoining Proskauer in 2015, Deidre served as shareholder and co-chair of the Employee Benefits Litigation Group at a national labor and employment defense firm. She also spent several years in London (2001-2005), where she qualified as a solicitor in England and Wales and practiced U. K. pensions law/litigation at one of the “Magic Circle” firms.
