Damian Myers is an associate in the Employee Benefits, Executive Compensation and ERISA Litigation Practice Center.

Damian represents public and private companies on matters related to employee benefits and executive compensation law, including compliance with ERISA, tax, corporate and securities laws and regulations affecting employee benefit plans, programs and arrangements. With respect to all types of benefit programs, Damian assists clients with plan design and preparation of plan documents, day-to-day plan administration matters, ERISA fiduciary matters and negotiation of service-provider agreements. Damian frequently advises clients with respect to defined benefit pension plans, 401(k) plans, 403(b) plans, non-qualified deferred compensation plans and equity-based compensation plans.

A significant portion of Damian’s practice involves assisting clients with their health and welfare benefit programs and the various laws and regulations that apply to them. In addition to advising on general ERISA requirements, he advises with respect to requirements under the Internal Revenue Code, HIPAA, COBRA, and the Mental Health Parity and Addition Equity Act. Damian has also developed expertise in the Affordable Care Act and keeps clients up-to-date as health care reform evolves.

Damian is frequent writer and speaker on all areas of employee benefits law. He is contributing editor of Mandated Health Benefits – The COBRA Guide.

Prior to joining Proskauer, Damian worked as an associate in the Washington, D.C. office of a large international law firm, where he advised public and private companies on all aspects of employee benefits and executive compensation law.
