Crispin Daly is an associate in the Firm's Business Solutions, Governance, Restructuring & Bankruptcy Group, with a focus on insolvency-based litigation.

He has represented liquidators, administrators, fixed-charge receivers, creditors and creditors' committees, shareholders and directors in a variety of situations including shareholder disputes, project finance initiatives, distressed asset and business sales (and related litigation), debt enforcement and asset tracing.

Key Representations

Multi-Jurisdictional Insolvency Matters

  • Administration of Lehman Brothers International (Europe): acting for captive insurers and secondary purchasers of claims
  • Special administration of MF Global: acting for the Statutory Creditors Committee of the US holding company and finance company
  • Liquidation of ARM Asset Backed Securities S.A.: representative bondholder trust litigation
  • Cross-border insolvency matters include establishing COMI of foreign companies in the UK; acting for foreign insolvency office holders in relation to investigating potential claims in the UK; representing foreign insolvency office holders in the UK; and representing UK insolvency office holders overseas including Northsea Base Investments Limited, DD Growth 2X Fund, Onix Capital S.A. and Caledonian Bank

General Commercial Litigation

  • Cases before the Commercial Court, Chancery Division, Court of Appeal and the Privy Council include BMA Special Opportunity Hub Finance Ltd. v African Minerals Finance Ltd and AG of Belize v Belize Telecom Ltd.
  • Defended employers against employee claims in the Employment Tribunal, sometimes in relation to insolvent companies.

  • Holds Higher Rights of Audience qualification to represent clients as a solicitor-advocate in civil proceedings in the English courts.
  • Experienced in sourcing and securing litigation funding and after the event insurance, and has acted for both claimants and litigation funders.
  • Represented clients in relation to buying and selling claims on a contingent basis.

Crispin has been a member of the INSOL Europe Technical Committee, with responsibility for planning and organizing the 2016 INSOL Europe Annual Congress. He has previously appeared as a panelist at the INSOL Europe Eastern European Countries’ Committee Conference in Cluj-Napoca, Romania. In addition, he is a frequent contributor to International Corporate Rescue.
