Andrew A. Smith is an associate in the Labor & Employment Law Department and a member of the Employment Litigation & Arbitration and Wage and Hour Groups.

Andrew focuses on defending employers in wage-and-hour class and collective actions. He has experience defeating certification and conditional certification in multiple states, as well as experience defending certified and conditionally certified class and collective actions involving claims by exempt and non-exempt employees.

Andrew has experience conducting large-scale workplace investigations and audits in connection with defending clients against pending and potential claims involving misclassification, overtime and off-the-clock work. In addition, he handles general employment counseling and has experience in reviewing and updating employee handbooks and company policies under federal and state law.

Andrew also defends claims of discrimination, retaliation, harassment, and wrongful termination in state and federal court lawsuits and alternative dispute resolution forums. In addition, he works with employers throughout the country to help ensure compliance with workplace laws and regulations such as the Fair Labor Standards Act, Americans with Disabilities Act and the Family Medical Leave Act.
