OFCCP Issues Final Rules on Affirmative Action Obligations for Veterans and Individuals with Disabilities

In August 2013 the Office of Federal Contract Compliance Programs (“OFCCP”) released final rules implementing the Vietnam Era Veterans’ Readjustment Assistance Act (“VEVRAA”) and Section 503 of the Rehabilitation Act. The rules adopt for the first time utilization goals and benchmarks for the hiring and placement of qualified individuals with disabilities and veterans.

As OFCCP Director Pat Shiu explained in announcing the new rules, “For the first time, these rules provide metrics -- management tools that inform decision-making and provide real accountability -- to measure federal contractors’ progress toward achieving equal opportunity for people with disabilities and protected veterans.”

The coverage of these new rules is potentially expansive – applying to all traditional government contractors and subcontractors and many members of the banking, finance, construction, health care and education sectors. These ground-breaking new regulations will go into effect in mid-February 2014.
