Proskauer Rose Represents Clinton Foundation in Historic Agreement to Lower Prices and Ensure New Supply of Malaria Drugs

July 18, 2008 (New York, NY) - Proskauer Rose LLP, an international law firm with more than 750 lawyers worldwide, is proud to announce its representation of the William J. Clinton Foundation in its historic agreement with six international pharmaceutical companies, drug suppliers and drug ingredient producers to lower prices and ensure the new supply of malaria drugs for millions of people around the world.

Richard Zall, partner and Chair of Proskauer's Health Care Department, and Jaimi Gaffe, an associate in the Department, served as outside counsel to the Foundation in its negotiations with the international consortium of companies to establish an agreement to lower the price of a leading artemisinin-based combination therapy (ACT) for malaria by 30 percent and reduce the price volatility of artemisinin, the key raw material for ACTs, by 70 percent. The companies that comprise the consortium include Calyx, Cipla, Holleypharm, Ipca Laboratories, Mangalam Drugs and PIDI Standard.

The agreement will meet the growing global demand from up to 500 million people who require malaria treatment each year. The prices will be available to the 69 countries in Africa, Asia, Latin America and the Caribbean that make up the Clinton HIV/AIDS Initiative (CHAI) purchasing consortium.

Proskauer has represented the Clinton Foundation on a pro bono basis for several years. In addition to its work on the malaria agreements, the firm has represented the CHAI in its agreements with drug and diagnostic companies that have reduced prices for HIV/AIDS drugs and testing equipment by rationalizing the market for such products. Today, 1.4 million people are benefiting from medicines purchased under agreements negotiated by CHAI, several of which were done with the help of Proskauer. The firm has also advised the Clinton Foundation with respect to intellectual property issues raised by its drug purchasing programs, and has represented the Clinton Climate Initiative (CCI) in connection with its agreements with partners. CCI assists partner cities across the world in the development and implementation of large-scale projects that result in reductions in substantial energy use and greenhouse gas emissions.
