2008 H-1B Cap Reached

USCIS confirmed that the congressionally mandated H-1B cap for fiscal year 2008 was reached on the first day of filing. Although we expected the cap to be exhausted much quicker than last year, the overall number of petitions received the first day is far greater than most imagined. USCIS indicated that it received approximately 150,000 cap-subject H-1B petitions by late afternoon Monday, April 2, 2007.

USCIS has confirmed that it will use a random selection lottery process for all cap-subject filings received on April 2, 2007 and April 3, 2007. It is unclear at this point how many petitions were received in total on these two days. Further, USCIS has indicated that it is unclear as to how many of these petitions are subject to the US-earned masters' degree cap exemption.
