In an employment column, Arthur Silbergeld and Dawn Irizarry argue that by allowing a plaintiff who alleges a wrongful termination in violation of Sarbanes-Oxley to circumvent the procedural and investigative mechanisms of that statute by asserting a California tort law claim, a recent decision by a judge for the United States District Court for the Northern District of California undermines congressional legislative intent.
