Social Security Cannot Be Held Over Warrants, Circuit Rules
Steve Obus was quoted on the U.S. Court of Appeals for the Second Circuit ruling against the U.S. Social Security Administration that benefits cannot be suspended based on an outstanding warrant alleging a parole or probation violation. Obus, who represented the plaintiffs in the case pro bono, said he felt “gratified” with the court’s decision explaining that one cannot assume just because a warrant was issued that it was more than an accusation.

William Komaroff and Matthew Queler lead a trial team that successfully defended FBI Special Agent William Shirk III in a federal criminal trial in which Agent Shirk was charged with illegally sharing confidential information with an informant. The Proskauer team tried the case to a Rule 29 judgment of acquittal. Proskauer became involved in the case through Mr. Komaroff's service as a Criminal Justice Act panel attorney in the Southern District of New York, through which the firm takes on pro bono defense assignments.

One of the resources the program provides is assistance obtaining restraining orders, which are under civil, not criminal, jurisdiction, making the DA's office unable to provide representation for victims. By partnering with private law firms like Proskauer, the office can refer victims on a need basis who will represent them in court pro bono.
