| Biography:
Cliff litigates a full range of complex and other matters most of which arise in the commercial context. He has litigated, among other things, trademark, copyright, contractual, employment, First Amendment, white collar and probate matters.
Cliff has obtained favorable results for Proskauer's clients in both litigation and mediation, including the below recent examples:
- Multiple anti-SLAPP victories in federal court for an Ivy League university on a matter implicating libraries' First Amendment rights online (Ninth Circuit appeal pending);
- Summary judgment in favor of an online game/social networking corporation in a Lanham Act infringement/cybersquatting matter involving issues of first impression (Ninth Circuit appeal pending);
- Numerous mediated settlements in contractual disputes and complex litigation, including an employment class action for a major video game company; and
- Counsel of Record for amici curiae the Anti-Defamation League et al. in support of petitioners in California's marriage equality litigation, In re Marriage Cases, S.147999 (2008).
As a member of Proskauer's Privacy and Data Security Practice Group, Cliff advises numerous clients regarding compliance and best practices under rapidly-changing privacy, data security and Internet marketing laws and principles. Cliff's past and present clients include a major telecommunications company, financial services companies, airlines, employers, and other companies ranging from small to multinational. He advises clients on the Gramm-Leach-Bliley Act and associated regulations; state privacy laws affecting a wide range of industries; data privacy laws of the European Union and other foreign jurisdictions; FTC compliance; and behavioral marketing, among other things.
Cliff has authored and co-authored several articles in the Daily Journal and Employment Law 360. He co-authored the state law chapter of the Practicing Law Institute (PLI) treatise Proskauer on Privacy and regularly contributes to the Proskauer on Privacy blog (http://www.proskaueronprivacy.com). He has been quoted in several publications, including Employment Law 360, the Privacy Times and E-Commerce Times.
