| Biography:
Tzvia Feiertag practices exclusively in the areas of ERISA and employee benefits-related tax law. She advises a diverse group of public and private companies and nonprofit organizations on the design, operation and administration of qualified and nonqualified retirement plans, medical and disability plans, equity compensation plans, cafeteria plans, health reimbursement account plans and flexible spending account plans. Tzvia also counsels companies in the structuring and negotiation of executive/key employee compensation and benefits packages, and drafts and negotiates employment agreements in connection with the same
Tzvia has extensive experience handling plan termination issues for single employer plans as well as multiemployer pension plan withdrawal issues under Title IV of ERISA. Her employee benefits practice includes counseling in connection with fiduciary responsibilities, prohibited transactions, benefit claims matters, Internal Revenue Service and Department of Labor audits and corrective programs, and due diligence of employee benefit issues related to corporate mergers and acquisitions.
Tzvia also routinely counsels multiemployer trust funds in general benefits compliance areas such as ERISA, the Internal Revenue Code, participant communication, and COBRA and HIPAA. She also assists clients in addressing multiemployer pension plan funding. In addition, Tzvia provides legal advice concerning employee benefit plan investment arrangements, including drafting and negotiating investment management agreements, and other service provider agreements.
Tzvia has lectured on employers’ obligations under the HIPAA Privacy Rule and has authored articles on topics including deferred compensation arrangements, HIPAA, COBRA, and Medicare.
Tzvia received her Juris Doctor from UCLA Law School in 2001 and her Bachelor of Arts degree magna cum laude from Touro College in 1998. She is resident in Proskauer’s Newark office and is admitted to practice in New Jersey, New York, and California.
