| Biography:
Daniel J. Bernstein is a senior counsel in the Patent Law and Intellectual
Property Practice Groups at Proskauer Rose LLP. Mr. Bernstein's practice focuses
on the licensing and transfer of intellectual property rights for growth-oriented
companies primarily in the high technology and biotechnology industries. Mr.
Bernstein counsels technology companies and their investors on issues relating
to the protection and enhancement of intellectual property, and has substantial
experience with such clients in structuring product development and distribution
agreements, collaborative research arrangements, cross-licensing agreements,
strategic partnerships and joint ventures.
Daniel has counseled clients and negotiated alliances in diverse industry
sectors, including computer hardware, software, semiconductors, networking,
biotechnology, medical devices, polymer-coated textile manufacture and financial
services.
Daneil counsels clients on the license and transfer of intellectual
property rights in the context of acquisitions and divestitures, and on due
diligence issues arising in connection with such transactions.
In addition, Mr. Bernstein has substantial experience in the resolution of intellectual
property disputes, and has negotiated numerous agreements involving the cross-license
of patents and other intellectual property rights as part of the overall settlement
of contested claims.
Daniel is named in the 2007 and 2008 edition of Chambers USA: America's Leading Lawyers for Business.
Before reentering private practice, he was a Vice President and
Assistant General Counsel at Digital Equipment Corporation.
Daniel received his B.A., summa cum laude, from Cornell University in
1971 and his J.D. from New York University School of Law in 1974.
Daniel is admitted to New York Bar, the Massachusetts Bar, the U.S. District Court, District of Massachusetts, the U.S. Court of Appeals, First Circuit, and was Law Clerk to the Honorable William C. Conner, U.S. District Court, Southern District of New York.
