Biography:

Joseph A. Capraro, Jr. is a partner in the Patent Law and Intellectual Property Practice Groups at Proskauer Rose LLP. Mr. Capraro leads the patent and trademark prosecution and technology licensing groups in the Boston office. Over the course of his career, he has gained experience in all aspects of the protection and enforcement of intellectual property rights. He provides clients with practical legal advice across the entire spectrum of intellectual property areas -- including strategic intellectual property portfolio development; patent and trademark prosecution; technology licensing; intellectual property due diligence in corporate transactions; and patent, trademark, copyright and trade secret litigation.

Joseph represents technology start-ups as well as private and public emerging technology companies. He spends much of his time working with companies having products in the engineering arts, with particular emphasis on plasma devices, semiconductor equipment, power supplies, medical lasers, image processing devices, optical components, medical devices, alternative energy technologies, financial services, multimedia, software and telecommunications systems and software.

Joseph works closely with clients in developing national and international patent and trademark portfolios. Mr. Capraro's experience in the area of patent prosecution includes basic prosecution issues as well as patent reissue and re-examination proceedings in the United States and in patent opposition proceedings internationally.

Joseph has extensive experience in the area of technology and intellectual property licensing, including drafting and negotiating intellectual property licenses and cross-licenses, research agreements, product development agreements, distribution agreements and strategic partnership arrangements.

Joseph has participated in numerous intellectual property litigations and in alternative dispute resolution of intellectual property matters, involving patents, trademarks, copyrights and trade secrets.

Joseph's clients have included MKS Instruments, Inc.; Hypertherm, Inc.; Candela Corporation; Sonus Networks Inc.; athenahealth, Inc.; Nexx Systems, Inc.; and Physical Sciences, Inc. Mr. Capraro was selected as one of the leading attorneys in his field in New England Super Lawyer and 2007 and 2008 edition of Chambers USA: America’s Leading Lawyers for Business, in which he was praised for his "fabulous breadth of knowledge and practicality.”

Joseph received a B.S. in electrical engineering from Tufts University, magna cum laude, and a J.D., cum laude, from Suffolk University Law School.

Joseph is a member of the Boston Patent Law Association (co-chair of Patent Law Committee), and a member of the American Intellectual Property Law Association, Institute of Electrical and Electronics Engineers, Licensing Executive Society, and the Massachusetts Bar Association.

Joseph is admitted to the Massachusetts Bar, the U.S. District Court, District of Massachusetts, the U.S. Court of Appeals for the Federal Circuit, and is registered to practice before the U.S. Patent and Trademark Office.
