Biography:

Emily Stern is a senior counsel in Proskauer Rose LLP’s Litigation and Dispute Resolution Department. Emily has a broad-based and diverse litigation practice that covers both civil and criminal matters. In the civil arena, Emily represents clients in complex commercial matters in a range of industries, including pharmaceutical, entertainment, sports, financial services, consumer products and automotive. Her legal expertise is similarly broad, covering an array of substantive areas of the law, such as federal securities, insurance coverage, false advertising, trade secrets and unfair competition, legal ethics, and employment law. Emily has considerable civil trial experience in state and federal courts, as well as with private arbitral panels. She is also an experienced appellate practitioner. Emily is a member of the Firm’s Corporate Defense & Investigations Practice Group, International Practice Group and Financial Services Practice Group.

Most recently, Emily’s practice has expanded to the area of white collar criminal defense where she has been involved in federal criminal investigations relating to the reinsurance industry, broker-dealer practices and matters involving allegations of tax fraud. Her criminal experience includes international matters, such as the defense of an individual in U.S. v. Kozeny, the most substantial Foreign Corrupt Practices Act prosecution brought to date by the DOJ, and other matters involving international issues, such as extradition and the exercise of extraterritorial jurisdiction by the DOJ and SEC.

Emily has a strong commitment to pro bono legal service. She has substantial experience in the area of voting rights, including recently representing a consortium of voting rights organizations and voters seeking compliance by the State of New York with the Help America Vote Act of 2002, in particular as it relates to voters with disabilities and limited English proficiency; submitting an amicus brief to the United States Supreme Court in Crawford v. Marion County Bd. of Election regarding the constitutionality of voter ID laws, and overseeing an extensive investigation of a state’s administration of elections on behalf of prominent civil rights organizations. Emily has also handled, on a pro bono basis, matters involving children and families, including securing necessary services for students with special educational needs and handling Proskauer’s first adoption cases as part of the Pro Bono Adoption Project initiated by Chief Judge Judith Kaye of the New York Court of Appeals.

Emily came to the practice of law following a career in the performing arts. After graduation from New York University’s Tisch School of the Arts with a Bachelor of Fine Arts, Emily performed with a number of modern dance companies throughout the U.S. and Europe. She then attended the University of Wisconsin at Madison Law School, where she was an articles editor of the University of Wisconsin Law Review, a member of the Moot Court board and a teaching assistant in legal writing. She graduated from UW Law with honors.

Emily clerked for the Honorable Sidney H. Stein, United States District Court Judge for the Southern District of New York.
