Biography:

Jennifer Scullion litigates complex commercial cases, including antitrust, patent, and cross-border securities and debt matters. She represents clients in state and federal courts throughout the United States, as well as in arbitration and in international settings.

Jennifer’s recent representations include:

• Enforcing the rights of U.S. bondholders under the U.S. securities laws in the face of an attempted Argentine restructuring.

• Trial in U.S. Bankruptcy Court requiring Argentine debtor to offer U.S. creditors fair and equal compensation.

• Representation of multi-national medical products manufacturer in U.S. patent infringement litigation.

• Representation of U.S. and international sports leagues and governing bodies in antitrust proceedings.

• Representation of creditors in litigation under the Foreign Sovereign Immunities Act to enforce loans against Argentine instrumentality and controlling French and Spanish shareholders.

• Representation of medical products and pharmaceutical manufacturers in antitrust litigation.

Jennifer is a member of the firm’s International Practice Group and Antitrust Practice Group and Editor of Proskauer on International Litigation and Arbitration (www.proskauerguide.com), a comprehensive e-book collecting Proskauer’s practical and strategic experience advising and representing clients in international commercial and regulatory matters.

Jennifer also has substantial experience representing and advising both brand and generic pharmaceutical clients concerning complex matters under the Hatch-Waxman Act. She has represented clients in court and before the FDA on Orange Book listing and delisting issues, 180-day exclusivity rights, exclusivity “triggers”, and issues concerning co-exclusivity.

Jennifer also has an active pro bono practice. She represents voting rights organizations and individual plaintiffs in on-going litigation challenging the Constitutionality of Ohio’s election administration and voting systems and practices. She and dozens of other lawyers and staff at Proskauer also served as the Ohio Call-In Center for the nationwide Election Protection coalition in November 2006. Jennifer also serves on the firm-wide Pro Bono Initiative committee. In 2008, Jennifer was appointed to the Board of Trustees of the Lawyers' Committee for Civil Rights Under Law.
