| Biography:
Margaret Dale is a partner in the Litigation and Dispute Resolution Department and is resident in the New York office of Proskauer Rose. Margaret’s practice is as broad as the range of business disputes that are captured by the term "commercial litigation." She has tried cases in state and federal court and has handled proceedings before mediators and arbitrators. She is well-versed in all aspects of New York State and federal practice. Margaret focuses on complex commercial disputes, including claims of fraud and rescission.
Recent trials and substantive matters have included: representation of national bank in regulatory and class action disputes involving data loss; representation of consumer products company in insurance recovery litigation; insurance appraisal proceeding regarding losses sustained as a consequence of the September 11 destruction of the World Trade Center; arbitration of a corporate dispute concerning repayment and subordination provisions of a loan obligation; arbitration of a corporate governance and buyout dispute concerning a publishing company; six-month trial of claims of patent infringement and validity, unenforceability and fraud; arbitration of claims against foreign reinsurer in run-off, including issues of fraud and rescission; and trial involving claims of fraud, indemnification, and damages arising out of the sale of multiple manufacturing facilities located in the U.S. and abroad. Recent appeals have included cases in the Federal, Fourth and Eleventh Circuits and New York's Appellate Division.
In addition to general commercial litigation, Margaret regularly handles cases for clients involving white collar crime, securities litigation, and insurance and reinsurance disputes.
Margaret is also an author of the chapter titled “Recognition & Enforcement of Judgments” in the Proskauer on International Litigation and Arbitration, a comprehensive e-book collecting Proskauer’s practical and strategic experience advising and representing clients in international commercial and regulatory matters.
Margaret is a 1989 graduate of the University of Chicago Law School. From 1991 to 1994, Margaret served as an Assistant District Attorney in the King’s County District Attorney’s Office in Brooklyn, New York.
Margaret is a member of the American Bar Association, the New York State Bar Association, and the Association of the Bar of the City of New York. From 1995 to 2001, Margaret was a member of the State Bar’s Commercial and Federal Litigation Section. She was Secretary of the Section from 1995 to 1996, and Editor of NY Litigator from 1998 to 2000. At the City Bar, Margaret served on the Committee of the State Courts of Superior Jurisdiction from 2005-2007, and now sits on the Committee on Professional Discipline.
In 2005, Margaret was inducted into the YWCA’s Academy of Women Leaders. In 2007 and 2008, Margaret was recognized as a SuperLawyer.
