| Biography:
Mark A. Saloman is an attorney in Proskauer ’s Labor and Employment Law Department, resident in the firm’s Newark office. He handles employment litigation and advises clients throughout the country on all aspects of employment litigation and counseling, including discharge, discipline, and other personnel problems; sexual harassment investigations; and leave of absence issues. Mark’s practice concentrates on complex employment litigation and labor law issues at the state and federal levels, including wrongful termination, employment discrimination arising under Title VII and similar state statutes, sexual harassment, hostile work environment, constructive discharge and retaliation claims and defamation actions.
Mark is also a member of the firm’s Non-Compete and Trade Secret Group. He has litigated numerous cases and counseled clients concerning the meaning and enforceability of various types of post-employment restraints, such as non-competition agreements, non-solicitation provisions, confidentiality agreements, and other restrictive covenants.
Mark was named one of the top “40 Under 40” lawyers in 2007 by the New Jersey Law Journal. He is a frequent lecturer for the New Jersey Institute of Continuing Legal Education, the New Jersey Defense Association, the Council On Education In Management, the Employers Association of New Jersey, and other organizations. Mark has published over two dozen articles on employment law and litigation, is a contributing author of Vol. 18, New Jersey Practice – Employment Law, 2d Ed. (Marvin M. Goldstein, et al., eds., West Group, 2005), and often has been quoted in numerous publications.
He presented oral argument to the Supreme Court of New Jersey on behalf of an amicus curiae, the Employers Association of New Jersey, in the matters of Gerety v. Atlantic City Hilton Casino Resort, 184 N.J. 391 (2005) and Maw v. Advanced Clinical Communications, Inc., 179 N.J. 439 (2004). His other reported decisions include NASC Services, Inc. v. Mark is admitted to the State Bars of New Jersey, New York, and the Commonwealth of Pennsylvania, as well as the U.S. District Courts for the District of New Jersey, the Southern and Eastern Districts of New York, the District of Vermont, and the Second, Third, and Fourth Circuit Courts of Appeals. He has handled litigation matters to conclusion in these states, as well as in California, Colorado, Delaware, Florida, Georgia, Maryland, Massachusetts, North Carolina, and Ohio, and before the U.S. Equal Opportunity Commission and state civil rights enforcement agencies.
He has been certified by the New Jersey Office of Dispute Resolution as a mediator in accordance with New Jersey Court Rule 1:40-4 and conducts mediations on referral by the Superior Court of New Jersey and from private parties.
Mark received his B.A. summa cum laude with high honors from Brandeis University and his J.D. from the University of Pennsylvania School of Law. He served a judicial clerkship in the Superior Court of New Jersey with The Hon. Herman L. Breitkopf, A.J.S.C., and The Hon. Edward J. Seaman, P.J.S.C.
He is an Executive Committee member of the New Jersey Bar Association’s Labor and Employment Section and Chair of its Employee Benefits Law subcommittee; a member of the Board of Directors of the New Jersey Defense Association and Chair of its Employment Law Committee; and a member of Brandeis University’s Alumni Lawyers Network Steering Committee.
Mark also is a member of the Board of Directors of Community Hope, Inc. in Parsippany, New Jersey, and of the Board of Trustees of 1st Cerebral Palsy of New Jersey in Belleville.
