| Biography:
Anthony J. Oncidi is a partner in the Firm and the Chair of the Labor and Employment Department in the Los Angeles office. Mr. Oncidi represents employers in all aspects of labor relations and employment law, including litigation and preventive counseling, wrongful termination, employee discipline, Title VII and the California Fair Employment and Housing Act, wage and hour matters, including class actions, executive employment contract disputes, sexual harassment training and investigations, workplace violence, drug testing and privacy issues, confidential information, Sarbanes-Oxley claims, employee raiding and trade secret protection. A substantial portion of Mr. Oncidi's practice involves the defense of employers in large class actions, employment discrimination, harassment and wrongful termination litigation in state and federal court as well as arbitration proceedings.
Mr. Oncidi has represented employers in many important trial court and appellate cases, including Alch v. Superior Court, 122 Cal. App. 4th 339 (2004); Wynn v. NBC, Inc., 234 F. Supp. 2d 1067 (C.D. MCI Telecommunications Corp., 973 F. Supp. 1133 (C.D. Cal. 1997); Friend v. Sanwa Bank of Cal., 35 F.3d 466 (9th Cir. 1994); and Ohrbach's, Inc. v. California Ins. Guarantee Ass'n, 204 Cal. App. 3d 1089 (1989).
Mr. Oncidi is the author of the treatise titled Employment Discrimination Depositions (Juris Pub’g 2006; www.jurispub.com), co-author of Proskauer on Privacy (PLI 2006), and since 1990, has been a regular columnist for the official publication of the Labor and Employment Law Section of the State Bar of California and the Los Angeles Daily Journal. Los Angeles Magazine has identified Mr. Oncidi as one of the "Top 100 Southern California Super Lawyers," and he is listed in The Best Lawyers in America, as “Highly Recommended” (one of the top five employment lawyers in Los Angeles) by the Practical Law Company (PLC London) and is described as one of "America's Leading Business Lawyers" by Chambers USA. He is a Fellow of the College of Labor and Employment Lawyers – an honor conferred upon him by his peers throughout the United States. Mr. Oncidi is a regular commentator on employment-related issues for public radio station KALW-FM in San Francisco and has been a featured guest on Bill O'Reilly's "Radio Factor" and Fox 11 News in Los Angeles. He has been interviewed and quoted by leading national media outlets such as Bloomberg News, the New York Times, CBS News, and Newsweek and Time magazines. He is an appointed Hearing Examiner for the Los Angeles Police Commission and has served as an Adjunct Professor of Law at the University of Southern California Law School and a guest lecturer at the UCLA School of Law.
He is a frequent speaker on employment law topics for large and small groups of employers and their counsel, including the Society for Human Resource Management (“SHRM”), the National CLE Conference, National Business Institute, the Southern California Employment Round Table ("SCERT"), the Council on Education in Management, the Western League of Savings Institutions, the Institute for Corporate Counsel, the State Bar of California, the California Continuing Education of the Bar Program and the Los Angeles and Beverly Hills Bar Associations. Mr. Oncidi has testified as an expert witness regarding issues arising under the California Fair Employment and Housing Act and has served on the executive committees of the Labor and Employment Law Section of the State Bar of California and the Los Angeles County Bar Association. He has served as a faculty member of the National Employment Law Institute.
Mr. Oncidi has received the highest Martindale-Hubbell rating ("AV"), indicating "very high to preeminent legal ability and very high ethical standards as established by confidential opinions from members of the Bar." He received his Bachelor of Arts degree, cum laude, Phi Beta Kappa, from Pomona College, and his Juris Doctor degree from the University of Chicago Law School. He is a member of the State Bar of California and is admitted to practice before the U.S. Court of Appeals for the Ninth Circuit and the U.S. District Courts for the Northern, Central and Southern Districts of California.
