Biography:

Mark Theodore is a partner with the Los Angeles office of Proskauer Rose. He is admitted to practice in New York and California and several federal courts. Upon graduating from law school, Mr. Theodore worked for the General Counsel of the NLRB in Washington, D. C. In 1992, he entered private practice. Since that time he has devoted his practice almost exclusively to representing management in traditional labor law matters all over the United States. His practice deals mostly with union-free employers. This representation consists of management education, conducting extensive vulnerability audits and assisting clients in the development and implementation of preventive workplace practices, procedures and programs. In assisting these clients, Mr. Theodore strives to help them meet their goal of avoiding the filing of representation petitions by labor organizations, and, should a petition be filed, assists clients in proceedings before the NLRB. Mr. Theodore also has extensive experience handling unfair labor practice charges from the date they are filed through trial and appeal. Mr. Theodore also represents unionized employers in arbitration proceedings and in the negotiation and administration of collective bargaining agreements.

Mr. Theodore also handles various employment litigation matters in state and federal courts.

Mr. Theodore attended Cornell University School of Industrial and Labor Relations (B.S., 1987) and Catholic University School of Law (J.D., 1990), where he graduated in the top 10% of his class. Mr. Theodore has been recognized by Los Angeles Magazine as a “Southern California Super Lawyer” in each of the last four years.

Highlights of Mr. Theodore's Career Include:

  • Named one of Top 100 Labor Lawyers in America in 2007 by Labor Relations Institute, Inc.;

  • Only Labor Lawyer selected as one of state's top "20 Lawyers Under 40" by California Law Business in 2002;

  • Selected by Los Angeles magazine as one of the 2007 “Southern California Super Lawyers” for the fourth consecutive year;

  • Extensive counseling and training of management in matters of union avoidance in all industries;

  • Handled 70+ representation campaigns through to election in a wide variety of industries including health care, hospitality/service, manufacturing, distribution, maritime, retail, construction and others;

  • Representation of major employers in all stages and types of post-election litigation;

  • Successfully defended major theme park when NLRB sought bargaining order after union failed in two elections;

  • Successfully challenged the San Francisco International Airport Card Check Ordinance, forcing the union to attempt to organize through an NLRB election, resulting in the first and only known defeat of a union organizing attempt at the Airport;

  • Acted as lead negotiator for dozens of major companies in nearly all industries, including multi-unit, multi-location, multi-employer and multi-union bargaining;

  • Negotiated successful first contract for shipping agency during constant threat by union to shut down Port of Los Angeles;

  • Coordinated employer response in numerous strike situations, including at major Northern California nursing home chain, US West (involving 14 western states) and Overhead Door (replacement of work force followed by successful decertification);

  • Handled hundreds of arbitrations involving virtually every area of dispute, including contract interest arbitration, contract interpretation, just cause termination/discipline, benefits, pay rates, and hours of work.
