Biography:

Michael Weiss is a senior counsel in Proskauer Rose LLP’s Litigation and Dispute Resolution Department. He has 20 years of experience representing clients in a variety of business and entertainment-related areas. Mike has both prosecuted and defended claims of Lanham Act violations, common law trademark infringement, and unfair competition. Mike represented several of the major studios and networks in an intellectual property dispute pitting the rights of television and movie copyright holders against the manufacturer of a digital recording device. More recently, Mike defended a major pharmaceutical company in a case involving claims of unfair competition and misappropriation of trade secrets. Mike also has represented clients in the defense and prosecution of professional malpractice claims (legal and accounting).

In the late 1990's, Mike was part of a national defense team for American Honda Motor Co., Inc. in a multi-district dealer class action arising out of the criminal prosecution of several former executives of the company's sales division. Mike continues to represent American Honda in intellectual property, unfair competition, employment and business disputes. He represents Honda’s automobile racing subsidiary in transactional and litigation matters as well. In the late 1990’s, Mike was part of a national defense team for American Honda Motor Co., Inc. in a multi-district dealer class action arising out of the criminal prosecution of several former executives of the company’s sales division. Mike continues to represent American Honda in intellectual property, unfair competition, employment and business disputes. He represents Honda’s automobile racing subsidiary in transactional and litigation matters as well. He also has represented a number of commercial recording artists in disputes involving royalty payments, the application of the "7-year rule" to recording agreements, personal management disputes, and a professional malpractice lawsuit brought against a rap musician's former business manager. Mike represented clients, both corporate and individual, in a variety of business-related litigation disputes, including breach of contract disputes arising out of buy-sell agreements, disputes arising out of agreements between manufacturers and their sales representatives, employment agreement disputes, and disputes concerning marketing and distribution agreements.

Mike is a 1983 graduate of Boalt Hall School of Law. Before moving to Proskauer with his firm in 2000, Mike was a partner with McCambridge, Deixler & Marmaro LLP.
