Biography:

Robert P. Wagner is an associate in the patent law practice group of Proskauer Rose LLP's Litigation Group/Intellectual Property Group. As a registered attorney before the U.S. Patent & Trademark Office, Rob has experience in several areas of intellectual property/patent law practice, including patent prosecution, patent and other intellectual property litigation, and client counseling on issues of infringement and validity. This has included providing noninfringement/invalidity opinions to clients in connection with specific patents and state-of-the-art/right-to-use opinions in regard to specific products.

A primary focus of Rob's patent practice at Proskauer has been the evaluation of patents for inclusion in multi-party patent licensing programs, also referred to as patent pools. Specifically, Rob and others in the patent law practice group have acted as independent patent evaluators for the patent pools to determine whether patents are essential for implementing a certain technology, as set forth in a particular technical standard. Patents which are determined to be essential implementing the technology are then included in the patent pool and made available through a single license. Proskauer's patent law practice group has played an instrumental role in the creation and proliferation of these patent pools, which have enabled complex technologies which were previously difficult and expensive to license to be made easily and inexpensively available for licensing, which has furthered the trend of making complex technologies (e.g., DVD technology) easily and inexpensively available to the public.

Rob's work on the multi-party patent licensing programs concentrates on high technology patent issues pertaining to a variety of fields, including consumer electronics, optical disc technologies, video formatting and compression technologies, audio technologies, and wireless and other communications.
Rob has also had significant experience with other diverse fields of technology, including fiber optics and other optical technologies, computer networking and architecture, Digital Rights Management, computer software, computer printers, and auto alarm systems.

Rob received his B.S. degree in Physics from M.I.T. and his J.D. degree from the Columbia University School of Law. He is a member of the California and New York State Bars.
