Biography:

Evan L. Kahn is a partner in the New York-based patent law practice of Proskauer Rose LLP's Intellectual Property Group. A registered attorney before the U.S. Patent & Trademark Office, Evan concentrates his practice on high technology patent issues pertaining to a variety of fields including video, audio, consumer electronics, communications, networking, semiconductors, computer architecture, optics, encryption and software.

Evan's work has included licensing, patent procurement and counseling clients on issues of infringement and validity. This has included providing noninfringement/invalidity opinions to clients in connection with specific patents and right-to-use opinions in regard to specific products. He has also assisted clients in setting up their own patent management departments.

Evan has also assisted in evaluating and licensing patents pertaining to certain standards. In particular, he has assisted in forming and maintaining a pool of patents which are essential for implementing MPEG-2, an international standard for compressing video. Evan first provided his assistance on behalf of Cable Labs, a research and development consortium of cable television operators in North America, and continues to provide such assistance on behalf of MPEG LA, L.L.C., a company organized to administer the licensing of essential MPEG-2 patents. His assistance has included helping to identify holders of essential patents, including leading consumer electronics and communication companies of the world. He also helped evaluate patents to determine whether or not they are essential for implementing the MPEG-2 standard. Furthermore, he helped to draft the agreements for forming and managing the pool under which the MPEG-2 essential patents are made available in a single license.

Evan also assists in the formation of other patent pools on behalf of leading consumer electronics manufacturers and media companies concerning DVD technology, which pertains to recording, storage and playback of movies using a disc similar in size to a CD. He furthermore assists in the formation of pools on behalf of leading computer, semiconductor and consumer electronics companies concerning the Home Audio Video Interface (HAVi) standard, the IEEE 1394 standard and other related standards. The IEEE 1394 standard pertains to a standard bus for carrying digital computer and audio visual information between computers and consumer electronics appliances. The HAVi standard pertains to controlling such appliances.

In addition, Evan is assisting in forming other patent pools pertaining to video broadcast and scalable video compression.

In the litigation context, Evan assists in analyzing patents asserted on behalf of, or against, clients. In particular, he has helped clients choose which patents to assert against others.

His other clients include SkyStream Corporation, a California-based start-up company which manufactures digitally compressed video broadcast equipment, and Vantum Corporation, a Colorado-based start-up company which manufactures intelligent video appliances.

Evan received his B.S. in electrical engineering from the State University of New York at Buffalo. He received his law degree from the University of Houston, where he was an associate editor of the Houston Law Review.
