Biography:

Seth B. Schafler is a partner and practice leader in the Litigation and Dispute Resolution Department of Proskauer Rose LLP.

Mr. Schafler has extensive experience representing policyholders in coverage negotiations and disputes with their insurance companies, and litigating coverage issues in federal and state courts across the country. His experience covers a wide variety of insurance products including commercial general liability, directors’ and officers’, professional liability, errors and omissions, fiduciary liability, property, business interruption, and fidelity and marine and credit risk insurance, among others.

Mr. Schafler represents the lessees of the World Trade Center in the litigation involving their insurance claims for property and business interruption resulting from the September 11, 2001 terrorist attacks. He also represents, and has represented, many major U.S. and international corporations including Amerada Hess, Bear Stearns, Bovis Lendlease Holdings, Bristol-Myers Squibb, British Petroleum, Brunswick, Home Depot, International Paper, JPMorgan Chase, Keystone Shipping, Lucent, Omnicom, PepsiCo, the Philadelphia Eagles, Philip Morris Companies, PPL Corporation, Reynolds Metals, and The New York Times.

Mr. Schafler represents a leading Australian construction company in the analysis of insurance coverage related to illness claims made by rescue and clean-up workers following the collapse of the World Trade Center buildings on September 11th.

He also represents two of Wall Street’s leading investment banks regarding coverage and recovery issues related to high-profile settlement agreements made with the SEC, NY State’s Attorney General, and other entities.

Mr. Schafler is a prolific author and speaker. He has published articles in many journals, and has served as a faculty member in numerous insurance-related courses and seminars for the Practising Law Institute and other organizations. Mr. Schafler is a member of The Association of the Bar of the City of New York and of the New York State Bar Association, and is admitted to the New York and Missouri State Bars, as well as the United States Court of Appeals for the Second Circuit.

Mr. Schafler earned his B.A. from the University of Chicago and his J.D., cum laude, from Benjamin N. Cardozo School of Law, where he served as Articles Editor of the Law Review. After graduating from law school, Mr. Schafler served as a judicial clerk in the United States District Court for the Western District of Missouri.
