| Biography:
Joshua J. Pollack is a senior associate in the Litigation and Dispute Resolution Department of Proskauer’s Los Angeles office. Josh has extensive experience handling complex commercial litigation for corporate and individual clients before federal and state courts and various arbitration forums. Josh’s practice includes advising clients in a wide range of industries, including insurance, securities, health care, entertainment, banking, and hospitality.
Josh has successfully represented clients in connection with a variety of matters, including claims of trademark and copyright infringement, fraud, unfair competition, civil RICO, and breach of contract. Josh’s experience includes:
- Representation of most of the major motion picture studios and the four major television networks in their technology copyright action against ReplayTV, the distributor of personal video recorders.
- Representation of a Cuban-origin rum distributor in litigation involving claims of trademark infringement, trade name infringement, and unfair competition.
- Defense of a major insurance company in an arbitration involving claims by a former employee for violation of the federal age discrimination law and ERISA, and a variety of contract and tort claims under Texas law. The arbitration panel denied the Statement of Claim in its entirety, with prejudice.
- Defense of a shareholder accused of civil RICO violations for allegedly disparaging a New York corporation and its founder and majority shareholder. The trial court dismissed plaintiff’s claims with prejudice, and the decision was affirmed by the appellate court.
- Representation of car and truck rental companies against putative class action claims regarding the companies’ refueling practices.
- Representation of a French tobacco company in litigation involving complex swap transactions and the sale of financial derivatives.
- Representation of a California-based bank in litigation involving allegations of fraudulent transfers, fraud, and unfair competition.
- Representation of a global brand management company in an arbitration involving the rights and revenues associated with a children’s literary property.
Josh is committed to pro bono matters and has participated in the Constitutional Rights Foundation’s “Courtroom to Classroom” project, teaching the Constitution and the Bill of Rights to middle school students.
Before joining Proskauer in 1995, Josh earned his legal degree, cum laude, from the University of Pennsylvania. He was Special Projects Editor of the University of Pennsylvania Law Review and is a member of the Order of the Coif. He earned his undergraduate degree, summa cum laude, from Yeshiva University, where he received awards for ethics and character, and excellence in political science.
Josh is a member of the New York and California Bars, and is admitted to practice before the United States Court of Appeals for the Ninth Circuit, and the United States District Court for the Eastern and Southern Districts of New York and the Central, Northern, Southern, and Eastern Districts of California. He is a member of the American Bar Association and the Los Angeles County Bar Association. Josh lives in Los Angeles with his wife and four children.
