| Biography:
Paul, co-chair of Proskauer’s 150-attorney global Labor and Employment Law Department, is widely recognized as one of the leading U.S. labor and employment lawyers.
Named by Human Resources Executive Magazine and Lawdragon as one of the “Nation’s 50 Most Powerful Employment Attorneys,“ Chambers USA consistently ranks him as one of “America’s Leading Lawyers for Business” in the employment law field. The Legal 500 calls him “a first class senior partner with excellent advice, excellent business judgment, and a result-focus[ed] orientation…” He appears in Best Lawyers in America; New York Super Lawyers; the Guide to the World’s Leading Labour & Employment Lawyers; and other similar publications and rankings. His peers have elected him a Fellow of the College of Labor and Employment Lawyers.
Clients that Paul frequently represents include the Realty Advisory Board on Labor Relations (RAB), as well as many of the individual companies that comprise the New York and national real estate and construction industries; NYSE Euronext; Natixis; MBIA Insurance; and Polo Ralph Lauren.
Paul negotiates major collective bargaining agreements in several industries, including real estate and construction. He tries arbitrations and litigations arising from the collective bargaining relationship.
In its 2009 term, Paul argued and won before the United States Supreme Court in 14 Penn Plaza LLC v. Pyett. In a landmark 5-4 decision of importance to employers, the Court held that a collective bargaining agreement that explicitly requires union members to arbitrate employment discrimination claims is enforceable.
Paul also handles all types of employment litigation, arbitration, and mediation. He spends much of his time providing advice and guidance to clients, counseling employers on how to avoid litigation and achieve their employee relations objectives through such techniques as proactive human resources policies and alternative dispute resolution.
Paul is an honors graduate of Cornell University's School of Industrial and Labor Relations (ILR) and Cornell Law School. He serves on the University's Board of Trustees. He is the past Chair of the ILR Dean’s Advisory Council (2004-06) and President of the ILR Alumni Association (1995-99). In 2002, ILR awarded Paul the Judge William B. Groat Distinguished Alumni Award, ILR’s highest honor.
An active speaker and writer on labor and employment law issues, Paul is frequently quoted in the business media. Among other groups he works with, Paul is a speaker for the Society for Human Resource Management (SHRM), where he served on its National Labor Relations Panel (1994- 2007). He also is the longtime Legal Columnist for Human Resource Executive Magazine.
