Biography:

Hank Goldsmith is a commercial litigation partner, resident in Proskauer’s New York Office.

Although his practice emphasizes the financial services industry (representing private equity firms, hedge funds, broker-dealers, FCM’s, and individual officers, directors and shareholders), the real estate industry (representing property owners, investors, and lenders) and the intellectual property industry (representing major copyright owners in the television, motion picture, music and print fields), Hank also represents a broad spectrum of clients needing assistance to enforce or defend their rights, whether the client is in one of the above industries, or is an international chemical company, a manufacturer of industrial transportation vehicles, a food distributor, a foreign state-owned computer manufacturer, a large bank, an entertainment venue, an individual or group of individuals, etc. Hank approaches each matter with the same guiding principle, regardless of the client or area of law involved, or the forum where the matter is to be litigated, arbitrated, or negotiated: First and foremost, what does “victory” mean to the client, and how best can those objectives be achieved?

Hank is a member of the New York State bar, is admitted to practice in numerous federal courts throughout the nation, and serves clients throughout the world. Hank has represented clients in proceedings in New York, New Jersey, California, Nevada, Massachusetts, Michigan, Texas, Florida and elsewhere, and has appeared in arbitrations before the NASD, AAA, and ICC in both the U.S. and in Europe.

River Capital International Group LLC, 2003 U.S. Dist. LEXIS 4619 (S.D.N.Y. 2003); A&M Records, Inc. v. Napster, Inc., 2001 U.S. Dist LEXIS 2186 (N.D. Cal. 2001); HT Capital Advisors LLC v. Optical Resources Group, Inc., 276 A.D.2d 420 (1st Dep’t 2000); Morris v. Bush, 1999 U.S. Dist. LEXIS 9994 (N.D. Tex 1999); Princeton University Press v. Michigan Document Services, Inc., 99 F.3d 1381 (6th Cir. 1996); Wichita Falls Office Associates v. Banc One Corp., 978 F.2d 915 (5th Cir. 1992); and Basic Books v. Kinko’s Graphics Corp., 758 F. Supp. 152 (S.D.N.Y. 1991).

Hank’s articles on litigation techniques (and substantive areas such as securities laws) have appeared in the New York Law Journal, and he has appeared on CNN as a guest legal commentator. He has lectured on trial techniques in complex commercial cases before the New York County Lawyers’ Association, and been a PLI panel member lecturing on the protection of intellectual property in the digital age.

Hank received a B.A. with honors from S.U.N.Y. Binghamton in 1984, and a J.D. with honors from The Georgetown University Law Center in 1987. He is a member of the American, New York State, and New York City Bar Associations. He is also a “gigging” musician, playing when his schedule permits it for live audiences in New York City.
