| Biography:
Karen E. Clarke is a senior associate in Proskauer Rose LLP's Litigation and
Dispute Resolution Department, resident in the New York office.
Karen's practice involves a variety of commercial litigation matters for companies
large and small, most often in state or federal courts in New York and New Jersey.
Typical matters concern contract disputes, securities cases, enforcement of
judgments, business torts, consumer fraud, corporate dissolutions, and insurance
disputes. She has handled several class actions on behalf of defendant corporations.
Her most recent success was in a putative class action against Henry Schein,
Inc. d/b/a Caligor, a distributor of medical supplies, in which the court determined
that no class at all would be certified.
Karen also has done a significant amount of appellate work, including two successful
affirmances in the Appellate Division, First Department, and the New York Court
of Appeals on behalf of DaimlerChrysler Canada Inc. in a case involving the
enforcement of a $300 million English judgment against a New York hotel owned
by the judgment debtors. Most recently, Karen prepared an appellee brief in
the federal Court of Appeals for the District of Columbia Circuit on behalf of the New York State
Bar Association, in opposition to the position of the Federal Trade Commission
that practicing lawyers should be subject to the Gramm-Leach-Bliley Act (which
requires financial institutions to send their customers notices concerning their
practices in disclosing private customer information to other financial institutions).
Karen also frequently assists in authoring articles for the Corporate and Securities
Litigation column of the New York Law Journal. These articles concern
various recent developments in securities and class action litigation.
Karen received her law degree from Rutgers University School of Law, Newark,
in 1988. She was a Managing Editor of the Rutgers Law Review. Following
law school, Karen clerked for Magistrate Judge Michael H. Dolinger of the Southern
District of New York for one year before joining Proskauer. Karen received a
B.A. from the College of William and Mary in 1981. Karen is admitted to the
state and federal courts in New York and New Jersey. She is also a member of
the American Bar Association.
