We provide skilled representation in discrimination, harassment, whistle blower and wage and hour cases, and are frequently called upon to litigate the enforceability of various post-employment restraints such as non-competition, non-solicitation, confidentiality agreements and other restrictive covenants.
Our New Jersey office also boasts a significant and seasoned traditional labor relations practice. Our lawyers represent employers in complex matters arising under the National Labor Relations Act, the Railway Labor Act, and collective bargaining agreements, including unfair labor practice charges, organizational drives and arbitrations. We also negotiate labor agreements and advise employers regarding the labor law issues that arise in mergers and acquisitions or when businesses restructure.
Our nationally renowned employee benefits litigation practice handles cutting-edge litigation and counseling in cases involving denial of benefits, breach of fiduciary duty and other issues implicating ERISA. Our contingent of Newark-based ERISA litigators are key players in the firm's national practice, which Chambers USA refers to as an "ERISA litigation juggernaut."
We are trusted business advisors to our clients. We advise employers on day-to-day human resource issues such as hiring practices, discipline, reductions in force and other terminations, wage and hour issues and compliance audits, immigration issues, accommodations, and employee complaints. We also counsel employers on steps to take in order to avoid costly litigation and government investigations.
Newark is home to Proskauer’s highly-regarded national Immigration Nationality Group, which assists companies across the country in obtaining the work authorizations and visas necessary to hire foreign nationals or transfer executives between countries, and defends employers against claimed immigration violations. Our immigration work includes pro bono asylum cases, including The List Project, which resettles Iraqi refugees who are at risk because they had assisted U.S. forces.
