Associates starting out in the department have the opportunity to work on a wide variety of labor, employment and employee benefits law matters, from day-to-day counseling, to negotiations, to sophisticated litigation at the local, state, federal and appellate level.

Trial experience: Looking to get into the courtroom? We represent clients involved in seminal and precedent-setting cases. Our lawyers have extensive “first chair” experience in the courtroom and a strong record of success before juries, judges, arbitrators and other tribunals.

Class/collective action: Proskauer is the place to be for class and collective action work. We work on class action matters in connection with discrimination, wage and hour, and ERISA claims, and are well versed in their defense and successful resolution. Our team tried and won one of the very few wage and hour collective action cases to ever go to trial.

Whistleblowing & retaliation: Matters involving whistleblowers have been making headlines around the country. Our whistleblowing practice has emerged as a center of knowledge and experience for our clients, counseling on and defending and preventing against whistleblower litigation in the U.S. and internationally.

Representative Matters

  • Representing Creative Artists Agency in its breach of contract claims against United Talent Agency and a group of defecting agents.
  • Represented New Jersey Transit in its successful negotiations to avoid a transit strike that would have affected more than 100,000 daily riders.

  • Represented more companies in class actions challenging unpaid internships than any firm in the country, including the precedent setting win where the Second Circuit adopted our position in its entirety and rejected the standards for determining “employee” status under the FLSA that were advocated by both the plaintiffs and the Department of Labor. Clients include: Fox Group, Inc., Condé Nast, Barneys, Marvel Entertainment, Donna Karan, Gawker Media, ICM Partners, Marc Jacobs, Tory Burch, Sony Music, CBS and others.

  • Successfully handled three individual cases for McDonald’s, which started as purported class action, claiming race, national origin, religion and age discrimination.

  • Go-to labor counsel to the National Football League, Major League Baseball, National Basketball Association, National Hockey League, Major League Soccer and Women's National Basketball Association; have handled class actions and collective bargaining – including the resolution of high-profile lockouts.

  • Resulting in a favorable ruling from the Supreme Court, we represented Amgen in an ERISA class action lawsuit, first filed in 2007, which alleged that fiduciaries of the Amgen 401(k) Plan breached their fiduciary duties.

  • Obtained dismissal of whistleblower lawsuit brought by a BAE Systems regional manager who worked on a Department of Defense contract in Afghanistan.

  • Serve as employee benefits counsel to numerous companies including McGraw Hill Financial, Citigroup Inc., Reed Elsevier and General Mills.

  • Serve as go-to labor counsel for The New York Times Company for more than 20 years.

  • Representing Bank of America in a pay equity ‘bro’s club’ class action.

  • Represented Yahoo! Inc.’s Compensation Committee in the hiring of Marissa Mayer from Google as its new CEO.

  • Regularly counsel and handle litigation for various AmLaw100 Firms involving departing lawyers and former clients; disputes among partners; and litigation involving employees (including discrimination, harassment and whistleblower suits).
